In this system, <strong>financial transparency<\/strong> is a fundamental pillar for building trust and fostering loyalty among your contractors. <\/p>\n\n<p class=\"wp-block-paragraph\">And that&#8217;s where the activity account comes in!  <\/p>\n\n<p class=\"wp-block-paragraph\">This individual monitoring tool must be implemented by the umbrella company to manage each contractor. However, many umbrella companies underestimate this legal obligation. Some also struggle to comply with it effectively.  <\/p>\n\n<p class=\"wp-block-paragraph\">In this article, learn about:  <\/p>\n\n<ul class=\"wp-block-list\">\n<li>What is the activity account?  <\/li>\n\n\n\n<li>What must it contain according to the law?  <\/li>\n\n\n\n<li>What are the penalties for noncompliance?  <\/li>\n\n\n\n<li>And most importantly, <strong>how can we implement it in a compliant and effective manner<\/strong> using digital tools?<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\">What is the activity account under umbrella employement?<\/h2>\n\n<h3 class=\"wp-block-heading\">Definition and Legal Framework of the Activity Account in Umbrella Employment<\/h3>\n\n<p class=\"wp-block-paragraph\">The activity account is an <strong>individual financial tracking tool<\/strong> set up by the umbrella company for each contractor. It tracks all financial transactions related to the contractor\u2019s work: client invoices, social security contributions, management fee, net pay, financial reserve, etc. <\/p>\n\n<p class=\"wp-block-paragraph\">This requirement is set forth in two major pieces of legislation:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Article L.1254-25 of the Labor Code<\/strong>, resulting from the ordinance of April 2, 2015: \u201cThe umbrella employement company shall establish and manage an activity account for each contractor. The CRA is the document filled out each month by the contractor to report their days worked and assignments. The activity report provides data for the activity account, but they are indeed two separate documents.  <\/p>\n\n<h3 class=\"wp-block-heading\">Why is the activity account required?<\/h3>\n\n<p class=\"wp-block-paragraph\">The legislature imposed this requirement for several reasons:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Financial transparency: The <\/strong>contractor must be able to understand how their turnover is converted into salary, what deductions are made, and at what rates.<\/li>\n\n\n\n<li><strong>Traceability of cash flows: In <\/strong>the event of an audit (by URSSAF or the labor inspectorate) or a dispute, the activity account serves as proof of proper management of the umbrella company.<\/li>\n\n\n\n<li><strong>Trust and Loyalty: A <\/strong>consultant who understands their compensation is a loyal consultant. Transparency is a key differentiator in the umbrella company market. <\/li>\n\n\n\n<li><strong>Basis for calculating the financial reserve: The <\/strong>activity account is used to track the mandatory contributions to the reserve (10% of base salary) and any withdrawals from it.<\/li>\n<\/ul>\n\n<h2 class=\"wp-block-heading\">What must the activity account include? The 7 required elements <\/h2>\n\n<p class=\"wp-block-paragraph\">Article L.1254-25 of the Labor Code and the collective bargaining agreement specifically list the seven items that the umbrella company must provide to the contractor <strong>each month<\/strong>.<\/p>\n\n<h3 class=\"wp-block-heading\">Payments from the client company<\/h3>\n\n<p class=\"wp-block-paragraph\">The activity account must list any payments made by the client company to the umbrella company in connection with the provision of services. Specifically, this includes: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>The invoiced amount (excluding tax and including tax)<\/li>\n\n\n\n<li>The billing date<\/li>\n\n\n\n<li>The actual payment date<\/li>\n\n\n\n<li>If applicable, invoices awaiting payment<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong><em>Practical tip: <\/em><\/strong><em>Careful tracking of payments received allows you to anticipate late payments and keep the contractor fully informed in a transparent manner.<\/em><\/p>\n\n<h3 class=\"wp-block-heading\">Details of Management Fees<\/h3>\n\n<p class=\"wp-block-paragraph\">Management fees represent the compensation paid to the umbrella company for its services: administrative management, contract preparation, billing, payroll, support, etc.<\/p>\n\n<p class=\"wp-block-paragraph\">The activity account must include:<\/p>\n\n<ul class=\"wp-block-list\">\n<li>The management fee rate applied (generally between 5% and 10% of turnover excluding tax)<\/li>\n\n\n\n<li>The amount deducted during the period<\/li>\n\n\n\n<li>If applicable, a breakdown of the services included in this rate<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>Point to note: Transparency <\/strong>regarding management fees is a key factor for consultants when making their selection. These include: <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Expenses that can be billed to the client: travel <\/strong>, lodging, meals, and specialized equipment specified in the commercial contract.<\/li>\n\n\n\n<li><strong>Non-billable expenses: <\/strong>marketing <strong>expenses <\/strong>, training, and the consultant&#8217;s personal equipment.<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">For each expense, the activity account must include the amount, the nature of the expense, and the reference number of the associated receipt.<\/p>\n\n<h3 class=\"wp-block-heading\">Social Security and tax deductions<\/h3>\n\n<p class=\"wp-block-paragraph\">The umbrella employement company, acting as the employer, withholds and remits the mandatory social security contributions. The activity account must include the following details: <\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Employer contributions: approximately <\/strong>42% of gross pay (health insurance, retirement, unemployment, workers&#8217; compensation, training, etc.).<\/li>\n\n\n\n<li><strong>Employee contributions: approximately <\/strong>22% of gross pay (CSG, CRDS, supplemental pension, disability insurance, etc.).<\/li>\n\n\n\n<li><strong>Withholding tax (PAS): if <\/strong>applicable, based on the rate provided by the tax authorities.<\/li>\n<\/ul>\n\n<h3 class=\"wp-block-heading\">Net pay<\/h3>\n\n<p class=\"wp-block-paragraph\">The activity account shows the amount of compensation actually paid to the contractor, after deducting all expenses. This amount includes: <\/p>\n\n<ul class=\"wp-block-list\">\n<li>Base Salary<\/li>\n\n\n\n<li><a href=\"https:\/\/veryswing.com\/en\/how-do-you-calculate-vacation-pay-for-freelance-workers.html\" target=\"_blank\" rel=\"noreferrer noopener\">Paid vacation<\/a> pay (10% of gross pay)<\/li>\n\n\n\n<li>Any bonuses or benefits<\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\"><strong>Legal reminder: The <\/strong>minimum gross salary under umbrella employement is 75% of the monthly Social Security ceiling (PMSS) for a senior contractor, which amounts to \u20ac2,943.75 gross in 2025 for full-time work.<\/p>\n\n<h3 class=\"wp-block-heading\">Business Referral Bonus<\/h3>\n\n<p class=\"wp-block-paragraph\">Since the contractor is the one who initiates the assignment (he or she identifies potential clients, negotiates, and brings in the client), he or she receives a business referral bonus in recognition of this sales work.<\/p>\n\n<p class=\"wp-block-paragraph\">According to Article L.1254-9 of the Labor Code, this compensation is set at <strong>5 percent of gross pay<\/strong> unless an industry-wide agreement specifies a different amount.<\/p>\n\n<p class=\"wp-block-paragraph\">The activity account must clearly state the amount of this compensation and the conditions under which it is paid.<\/p>\n\n<h3 class=\"wp-block-heading\">The financial reserve<\/h3>\n\n<p class=\"wp-block-paragraph\">The financial reserve is a mandatory savings fund established to provide security for the contractor during periods of inactivity or at the end of their contract. This reserve is guaranteed by the AGS (Association for the Management of the Employee Claims Guarantee Program) in the event of the umbrella company\u2019s default. <\/p>\n\n<h2 class=\"wp-block-heading\">What are the penalties for noncompliance?<\/h2>\n\n<p class=\"wp-block-paragraph\">Failure to comply with the requirement to establish and manage the activity account exposes your umbrella employement company to significant penalties.<\/p>\n\n<h3 class=\"wp-block-heading\">Criminal Penalties for the Umbrella Company<\/h3>\n\n<p class=\"wp-block-paragraph\">Article L.1255-14 of the Labor Code (11) provides that a contractor under an umbrella employement arrangement is subject to a fine of <strong>\u20ac3,750<\/strong> for \u201cto fail to comply with the obligation to establish and manage an activity account for each contractor in accordance with the provisions of Article L. 1254-25.\u201d<\/p>\n\n<p class=\"wp-block-paragraph\">In the event of a repeat offense, the penalties are more severe:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>6 months in prison<\/strong><\/li>\n\n\n\n<li><strong>A fine of 7,500 euros<\/strong><\/li>\n\n\n\n<li><strong>Prohibition on engaging in umbrella employement activities for a period of 2 to 10 years<\/strong><\/li>\n<\/ul>\n\n<p class=\"wp-block-paragraph\">These penalties apply to each affected contractor, which can quickly add up to very large amounts for an umbrella company that manages several dozen or hundreds of consultants.<\/p>\n\n<h3 class=\"wp-block-heading\">Operational and Reputational Risks<\/h3>\n\n<p class=\"wp-block-paragraph\">In addition to criminal penalties, failure to comply with this obligation exposes the umbrella company to other risks:<\/p>\n\n<ul class=\"wp-block-list\">\n<li><strong>Loss of trust among contractors: A <\/strong>contractor who doesn&#8217;t understand their compensation or discovers &#8220;hidden fees&#8221; will quickly leave the umbrella company for a more transparent competitor.<\/li>\n\n\n\n<li><strong>Labor Disputes: In <\/strong>the event of a dispute over compensation, the absence of a compliant activity account will constitute evidence against the employer.<\/li>\n\n\n\n<li><strong>Exclusion of Professional Federations: PEPS <\/strong>and <a href=\"https:\/\/syndicatportagesalarial.fr\/\" target=\"_blank\" rel=\"noreferrer noopener\">FEPS<\/a> require their members to strictly comply with legal obligations.
